Background
American Stewards of Liberty identified Texas’ “coordination” authority in 2007 while working to stop the Trans-Texas Corridor.
Since the early 1990s, ASL has helped local governments nationwide utilize coordination laws to defend their communities from federal and state overreach. Both federal and Texas statutes require agencies to coordinate with local governments. ASL has trained hundreds of local officials to use this powertul tool to ensure their voices are heard— and respected.
Legal Foundation
Under Texas Local Government Code Chapter 391, local governments within the same Council of Governments (COG) region may form a sub-regional planning commission.

- Unite local governments around shared concerns
- Develop regional plans and policies that are equal to, not subordinate to state plans
- Require state agencies to coordinate “to the greatest extent feasible”
- Strengthen local authority in decisions impacting land, resources, and communities
Forming a 391 Commission Resource
How to Form a 391 Commission
Build Your Coalition
Identify at least two local governments (county-county, city-county, or city-city) within the same COG region facing similar challenges.
Pass Resolutions
Each participating entity adopts a resolution formally creating the commission.
Hold the First Meeting
Adopt bylaws, consider additional members, and outline coordination priorities.
Establish Plans & Policies
Define your region’s positions on key issues affecting health, safety, and welfare.
Initiate Coordination
Send formal requests to relevant state agencies and schedule coordination meetings.
Prepare & Notify
Develop a clear agenda and provide proper public notice for meetings.
Engage & Act
Meet with agencies, assert local priorities, and work toward solutions that protect your community.
