Defense of Property Rights Act Filed

On Wednesday of this week, Rep. Nick Langworthy (R-NY) introduced the Defense of Property Rights Act.  Co-sponsors include Reps. Harriet Hageman (R-WY), Brad Finstad (R-MN), Paul Gosar (R-AZ), Claudia Tenney (R-NY), GT Thompson (R-PA), and Randy Weber (R-TX).

Langworthy’s bill addresses both federal and state infringement on private property rights under the Fifth Amendment and provides relief to landowners whose land has been affected by onerous regulations by establishing a more uniform and efficient Federal process.

Specifically, the bill:

  • Provides the opportunity for compensation when government action significantly impairs the value of the property.
  • Sets significant impairment of property rights at $20,000 or 20% of property value, whichever is less.
  • Gives the landowner standing to challenge and bring a civil action in the United States District Court or the United States Court of Federal Claims.
