Defeating Carbon Pipeline in South Dakota May be Revived by Congress’ Reconciliation Bill

Earlier this year, ASL reported in Liberty Matters how the landowners won a major victory over Summit Carbon Solutions and the carbon sequestration pipeline they intended to build through five states, including South Dakota.

Now, there are concerns the Republican’s Reconciliation package (Trump’s “One Big Beautiful Bill”) might override the state law created in South Dakota prohibiting eminent domain for a pipeline carrying carbon dioxide.

Specifically, the reconciliation package includes the following language:  “Notwithstanding any other provision of law, if the Commission (Federal Energy Regulatory Commission) issues a license under subsection (c)(1) of this section and the licensee is in compliance with such license, no requirement of State or local law that requires approval of the location of the covered pipeline with respect to which the license is issued may be enforced against the licensee.”
