American Stewards has now intervened as a plaintiff in two of the five segments proposed for the 765kV transmission lines to transmit unreliable solar and wind energy to the Permian Basin in West Texas.
The Administrative Law Judges in both cases have granted ASL intervention status much to the chagrin of ONCOR, the utility company developing and constructing the two segments.
ASL has also helped local governments form three 391 sub-regional planning commissions located on all three main segments (see map) utilizing the Texas Local Government Code 391. This statute has a provision, 391.009(c) that states:
“In carrying out their planning and program development responsibilities, state agencies shall, to the greatest extent feasible, coordinate planning with commissions to ensure effective and orderly implementation of state programs at the regional level.”
ASL thanks the leadership of Kinney and Uvalde Counties and the City of Uvalde for forming a commission on the Solstice to Howard transmission line, Burnet County and the City of Burnet forming one on the Bell East to Big Hill line, and Erath and Somervell Counties forming a commission on the northern line known as the Dinosaur to Longshore line.
Under the 391 statute, these planning commissions will meet in a publicly-noticed meeting and demand both federal and state agencies consider and make consistent their plans with the local plans and policies. ASL is assisting each planning commission with advice and will provide assistance during the coordination meetings.
